Well, first off it's not a battery, it's a capacitor. And secondly, the Patent office doesn't require a working example to issue a patent.

But if it works, it means they get to make the profit from it, so everybody has to license it from them, or rather from Zenn if they want to use it in a car. Nobody has signed exclusivity for trucks or heavy duty vehicles yet.
